West Flagler Files Again in Supreme Court Ask on Florida Sports Betting:

On Thursday, West Flagler Associates filed a writ petition with the Supreme Court of the United States in the Florida sports betting case against the Department of the Interior. The petition seeks clarity on the legality of sports betting in Florida, as different jurisdictions have made varying decisions on the matter.

Attorney Hamish Hume and his colleagues argue that the court should grant the petition to ensure consistency in the law regarding the scope of the Indian Gaming Regulatory Act (IGRA) and the Unlawful Internet Gambling Enforcement Act (UIGEA). They also argue that providing a statewide gambling monopoly to an Indian tribe while criminalizing the same conduct for all others is unconstitutional.

Justice Brett Kavanaugh has also expressed interest in the equal protection issues raised in the case. In October, he suggested that the state law may raise serious equal protection concerns if it only authorizes the Seminole Tribe to conduct certain off-reservation gaming operations in Florida.
