The disturbing case of a Florida woman suing Uber has brought to light the rideshare company's screening process for drivers. The plaintiff, who was allegedly raped by her driver on her 21st birthday in December 2021, claims that Uber failed to properly vet their driver, Luis Oliveras-Rivera, who had eight prior felony convictions.
Oliveras-Rivera's criminal history raises serious questions about Uber's safety protocols. A screenshot of his Uber profile showed that he had "passed a multi-step safety screen" and was listed as an Uber Pro Platinum driver, the company's highest tier. However, his record tells a different story. According to the plaintiff's lawyer, Lewis, Oliveras-Rivera's convictions were a red flag that should have disqualified him from driving for Uber. A recent investigation by The New York Times found that Uber's screening process allows drivers with felony convictions to be approved as long as those convictions are at least seven years old.
In 22 states, including Florida, this lenient policy has raised concerns about public safety. Oliveras-Rivera's most recent conviction was in 2013, which, under Uber's current policy, would have allowed him to drive for the company.
